A Uni\u00e3o Europeia est\u00e1 a debater a aprova\u00e7\u00e3o de um regulamento conhecido como Regulation to Prevent and Combat Child Sexual Abuse (CSAR)<\/strong>, apelidado de Chat Control<\/strong>. O objetivo declarado \u00e9 combater a dissemina\u00e7\u00e3o online de material de abuso sexual de menores, obrigando as plataformas digitais a detetar, reportar e remover esse tipo de conte\u00fado.<\/p>\n O que est\u00e1 em causa<\/strong><\/p>\n De acordo com os documentos oficiais, o regulamento poder\u00e1 aplicar-se a servi\u00e7os de mensagens, redes sociais, email e plataformas de partilha de ficheiros. Isso inclui tamb\u00e9m servi\u00e7os que utilizam encripta\u00e7\u00e3o ponta-a-ponta (E2EE)<\/strong>, at\u00e9 agora considerados espa\u00e7os de comunica\u00e7\u00e3o totalmente privados.<\/p>\n Nos textos mais recentes do Conselho da Uni\u00e3o Europeia, surge a proposta de usar tecnologias de dete\u00e7\u00e3o diretamente no dispositivo do utilizador<\/strong> (client-side scanning). Ou seja, o conte\u00fado seria analisado antes<\/strong> de ser encriptado ou enviado, procurando imagens, v\u00eddeos ou links suspeitos. Desta forma, a encripta\u00e7\u00e3o em si n\u00e3o seria desfeita, mas a comunica\u00e7\u00e3o deixaria de ser completamente privada, j\u00e1 que parte do conte\u00fado seria inspecionada em claro.<\/p>\n Salvaguardas e preocupa\u00e7\u00f5es<\/strong><\/p>\n O Parlamento Europeu, atrav\u00e9s da Comiss\u00e3o LIBE e de outros pareceres, tem defendido que a encripta\u00e7\u00e3o ponta-a-ponta deve ser preservada<\/strong> e que qualquer medida de dete\u00e7\u00e3o seja limitada, proporcional e sujeita a fortes salvaguardas legais. Entre as medidas discutidas est\u00e3o:<\/p>\n Apesar disso, peritos em ciberseguran\u00e7a, reguladores de prote\u00e7\u00e3o de dados e organiza\u00e7\u00f5es de direitos digitais alertam que o client-side scanning pode criar vulnerabilidades e reduzir a confian\u00e7a dos utilizadores nos servi\u00e7os digitais.<\/p>\n O que significa para os utilizadores<\/strong><\/p>\n Se o regulamento for aprovado na sua forma atual, os utilizadores poder\u00e3o ver mudan\u00e7as em aplica\u00e7\u00f5es de mensagens e redes sociais, com mecanismos autom\u00e1ticos de verifica\u00e7\u00e3o nos seus dispositivos. Formalmente, a encripta\u00e7\u00e3o ponta-a-ponta continuaria a existir, mas a sua promessa de confidencialidade total seria mitigada.<\/p>\n Na pr\u00e1tica, o Chat Control coloca lado a lado duas necessidades leg\u00edtimas mas dif\u00edceis de conciliar: a prote\u00e7\u00e3o de menores contra abusos online<\/strong> e a defesa do direito fundamental \u00e0 privacidade e \u00e0 comunica\u00e7\u00e3o segura<\/strong>.
